Notable Criminal Defense Cases: State

  • Rookie NYPD police officer acquitted of murder. The defense of justification (self defense) was successful despite the deceased being shot five times during an altercation with the defendant, and the defendant not testifying at trial. People v. Errick A.

  • Overturned a 22 year old murder conviction by arguing ineffective assistance of trial counsel, when lawyers from the same NYC law firm represented two co-defendants at a joint trial. Defendant was subsequently released from state prison and was sentenced to time served upon her plea of guilty to the reduced charge of Manslaughter in the First Degree. People v. Marie L. 

  • Not guilty trial verdict achieved for a 24 year old man accused of sexually assaulting a woman while they were on a Fire Island Beach. People v. Matthew S. 

  • Represented Mr. Zuckerman, Chairman of Boston Properties, Inc. and Owner and Publisher of The New York Daily News and U.S. News and World Reports, in East Hampton Town Court for various charges, including Leaving the Scene of an Automobile Accident (VTL Sec. 600.1). All charges were dismissed.

  • Achieved a full acquittal from a Brooklyn jury for a New York City elementary school science teacher accused of abusing five third and fourth grade students.

  • Client acquitted by a Nassau County jury of conspiring with numerous LIRR employees to steal over $250,000 of copper wiring from the railroad. This client was the only defendant charged in this 14 defendant case to be fully acquitted. People v. Craig B.

  • KeySpan employee acquitted of Extortion and Grand Larceny charges after a jury trial in Suffolk County. Client, a gas meter reader, was alleged to have unlawfully taken money from a homeowner by threatening to report asbestos in his residence. This not guilty jury verdict was obtained despite the client purportedly confessing to the crimes in a signed, written statement prepared by the arresting detective.

  • Represented the captain of the Kandi Won, a 34 foot Silverton yacht that capsized in Huntington Bay, after a July 4th fireworks display, causing the tragic death of three young children. After and extensive police investigation, no criminal charges were filed. 

  • Represented the Town of Smithtown Building Inspector indicted for Bribe Receiving, Official Misconduct and Filing of False instruments. People v. Robert B.

  • Earned the complete dismissal of all charges for a Town Public Works Commissioner accused of stalking and harassing an employee.

  • Attained dismissal of all charges against a man sought for years by law enforcement for damaging landmarks across Long Island by spray-painting graffiti.

Notable Criminal Defense Cases: Federal

  • Lead counsel to Mr. Singh, a prominent Long Island restauranteur, in this high profile political corruption, tax evasion and obstruction of justice prosecution by the United States Attorney, EDNY.  (Case is still pending.)

  • Achieved a full acquittal after a jury trial in the United Stated District Court, EDNY, before District Court Judge Arthur D. Spatt. Client was charged with conspiring with others, including lawyers, bankers and other professions, in carrying out a sophisticated scheme to defraud banks of mortgage proceeds totaling over $30 million. United States v. Joseph F.

  • Hired for the sentencing proceeding in this EDNY prosecution against Dr. Jacobson, who pleaded guilty to unlawfully distributing pain medication to his patients.  Achieved a favorable sentence after the submission of extension written memoranda and a lengthy sentencing hearing before United States District Court Judge Joseph F. Bianco.

  • Attained a favorable plea disposition for a former LIRR employee charged with disability fraud in this multi-defendant federal conspiracy prosecution in the SDNY. United Stated v. Philip P.

  • Received national media attention as lead counsel to a Babylon teenager charged in Federal Court for Providing Material Support to a Known Foreign Terrorist Organization. United States v. Justin K. 

  • Represented Chief Compliance Officer and Manager of a Long Island securities investment company investigated by the FBI for Securities Fraud in SDNY.  After an extensive defense investigation and negotiations with Southern District of New York federal prosecutors, achieved a non prosecution agreement.  United States v. Bobby C. 

  • Counsel to an Investigator for the Nevada State Attorney General's Office, prosecuted in the Federal Court for selling top-secret FBI documents that were given to alleged organized crime figures.  United States v. Maria E. 

  • Represented three defendants in separate gang related RICO murder cases in Federal Court, resulting in favorable plea dispositions.  United States v. Yobany C.; United States v. Edgardo S.-G.; United States v. Jose H.

  • Defended a Florida client for attempting to board a plane at MacArthur Airport with a pipe bomb, fireworks and a 7 inch knife in his backpack.  United States v. Steven N.

  • Retained by a prominent CA attorney to represent him as a trial witness in the federal prosecution of two financial planners who were accused of diverting the investments of various professional hockey players, including former New York Islanders players Michael Peca and Bryan Berard.
